特許第3393199号
特許「転送待ち時間割込みファイルｗｅｂサイトの設定方法」（通称NAOシフト？）について、いろんなところで議論がなされている。Javascript掲示板 とか。この特許を主張しているのは文化情報推進協議会（CIPA）。
訴えられないような措置をとっておかないと。
論点には、大まかに分けて次の２種類があるらしい。
(1) それは特許として有効なのか？
(2) その特許の抵触範囲はどこまでなのか？
(1)に関しては、もう特許として発表されたのだから、有効なものとして扱うしかないのだと思う。有効といえないと主張する人の根拠としては、「特許出願の97年より前に、この技術は常識の範囲だった」とするものや、「window.open() なんかは Javascript のただの機能に過ぎない」いうものが見受けられる。前者についてはなんともいえない、というわからない。そのころ私はIT分野でまだ物心ついていなかったし。後者については、この特許は「Webサイトの設定方法」であってスクリプトそのものを指しているのではないのだから、ちょっと食い違いがあるような気がする。たぶん、その食い違いの原因は、CIPAが ＜a href="**" target="_blank"＞でも特許の抵触範囲であるような言い回し（はっきりとは言ってない）をしていることにあるのだろう。つまり、「そこまでいうなら、それは単なるHTML or Javascript の機能でしょ。」という反論を生じさせている。
(2)に関しては、特許DBから内容を読んで判断することになる。ここからは、特許が有効なものという前提で書く。
私の解釈としては、
「onLoadイベントより前に別ウィンドウを開くページは、特許侵害といわれる危険性がある」
となる。
できるだけ素直に読むと、請求項としては以下のようになると思う（間違ってたらごめんなさい）。
【請求項１】「親ウィンドウの読込みと平行して小（子？）ウィンドウの作成→小ウィンドウの表示→小ウィンドウの消去」という一連の流れで、小ウィンドウの内容を乱数を使ってランダムなものにする方法。
【請求項２】請求項１の小ウィンドウを、親ウィンドウ読み込み完了と同時に消去する方法。
【請求項３】請求項１の小ウィンドウを、小ウィンドウ上の終了ボタンで消去する方法。
【請求項４】「親ウィンドウの読込みと平行して小ウィンドウの作成→小ウィンドウの表示→小ウィンドウの消去」という一連の流れにおいて、小ウィンドウに入力したURLを親ウィンドウに渡して、親ウィンドウを再度開く方法。
上記の請求項に共通しているのは、「親ウィンドウの読込みと平行して小ウィンドウを作成する」という点。【実施例】でも、そういう例になっている。
素直に解釈すると、＜body onLoad="window.open('**')"＞ という処理はこの特許にあてはまらない。なぜなら、onLoadイベントは、ページ読み込み「完了」イベントのはずだから。もちろん、target='_blank' とかも当てはまらないことになる（ただ、微妙なのは、画像とかを読み込み完了する前にリンクをクリックすることだってできるでしょ、っていわれたらどうするかという点。）。
反対に、「onLoadよりも前に小ウィンドウを開くページ（【実施例】では、＜head＞の中で open処理をべた書きしている）」は、自動で消えようと、ボタンで消えようと、特許内容の範疇になる恐れがある。というか、そう主張されたら反論が難しいのではないだろうか。「終了ボタン」が何かは決められていないので、「windowsのウィンドウの右上の「×ボタン」も「終了ボタン」だ」という主張は、特許の内容からは可能ではある。
なので、私は少なくとも、「onLoadイベントより前に別ウィンドウを開くページ」はやめておこうと思う。
なんにしろ、CIPA は請求業務なんてしてないといっているのだし、大きな問題が起こらないことを祈る。
